Terms of Use

These terms are an agreement between you and Technology Resolution Group LLC (“Kemback”, “we”, “us”) about your use of the Kemback website, web app and mobile apps (together, “the Service”). Please read them. By creating an account or using the Service, you agree to them. If you don’t agree, don’t use the Service.

1. Who can use Kemback

You must be at least 18 years old and able to form a binding contract. If you use Kemback for an organization, you confirm you’re authorized to accept these terms for it.

2. Your account

  • Give us accurate information, including an email address you can receive mail at.
  • Keep your password, passkeys and two-step verification codes safe. You’re responsible for what happens under your account.
  • Tell us straight away at hello@kemback.com if you think someone else has used your account.

3. Households

A household is a shared space for accounts, budgets and transactions. When you invite someone into your household, they can see and, depending on the role you give them, change what’s shared with that household. Accounts you mark as private stay visible only to you. You’re responsible for who you invite and the roles you give them. Owners can change roles and remove members.

4. Your data

You own your data. The financial information, files and other content you put into Kemback (“Your Data”) remain yours.

You give us permission to store, process and display Your Data only as needed to run the Service for you and the members of your households: for example, to show your register, calculate your budget, send the alerts you ask for, and keep backups. We don’t sell Your Data, and we don’t use it to advertise to you. Our Privacy Policy explains what we collect and how we handle it.

You can export Your Data at any time from the app, in JSON and CSV formats.

5. Bank connections

Where the Service offers automatic bank connections, they’re provided through a third-party aggregator (such as Plaid). You authorize the aggregator directly, and its own terms and privacy policy apply to that connection. Kemback never asks for or stores your bank username or password. Bank data can be delayed, incomplete or wrong, and banks can change or end their connections. Always check important balances with your bank.

6. Plans and payment

The Free plan is free. Paid plans, when offered, are billed in advance for the period you choose, and renew automatically until you cancel. We’ll show the price, and any taxes, before you pay. You can cancel any time; you keep paid features until the end of the period you’ve paid for. Except where the law requires otherwise, payments are not refundable. If we change a paid plan’s price, we’ll tell you at least 30 days before it applies to you, and you can cancel before then.

7. Acceptable use

Don’t:

  • break the law, or use Kemback to help anyone else break it;
  • access another person’s account or household without their permission;
  • probe, scan or test the Service’s security without our written permission (to report a vulnerability, write to security@kemback.com);
  • disrupt the Service, overload it, or get around its limits;
  • copy, scrape or resell the Service, or use it to build a competing product;
  • upload malicious code or content you have no right to share.

We may suspend or close accounts that break these rules, and we’ll tell you why unless the law or safety prevents it.

8. Not financial advice

Kemback is a tool for organizing your own information. Budgets, forecasts, “safe to spend” figures, reports, alerts and blog articles are general information based on the data you provide. They are not financial, investment, tax or legal advice, and they can be wrong if the underlying data is. Make important decisions with care, and with a qualified professional where appropriate.

9. Our software and content

We own the Service, including its software, design and content (other than Your Data). We give you a personal, non-exclusive, non-transferable right to use it under these terms. If you send us feedback or ideas, we may use them without owing you anything.

10. Changes and availability

We’re improving Kemback all the time, so features will change. We aim to keep the Service available, but we don’t promise it will always be available or free of errors. If we stop offering the Service, we’ll give you at least 60 days’ notice to export Your Data.

11. Ending your account

You can stop using Kemback at any time, and ask us to delete your account by writing to hello@kemback.com. We may end or suspend your access if you seriously or repeatedly break these terms, or if we have to by law. Sections 4 (ownership), 8, 12, 13, 14 and 15 continue after your account ends.

12. Disclaimer

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

13. Limitation of liability

To the fullest extent the law allows, Kemback and its owners, employees and suppliers won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$50. Some places don’t allow these limits, so they may not all apply to you.

14. Indemnity

If you break these terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable costs of dealing with that claim, to the extent the law allows.

15. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law rules. Any dispute relating to these terms or the Service will be brought in the state or federal courts located in New Jersey, and you and we consent to their jurisdiction. Before starting any claim, please write to us at hello@kemback.com so we can try to resolve it informally.

16. Changes to these terms

We may update these terms. If a change is significant, we’ll tell you by email or in the app at least 30 days before it takes effect. The date at the top shows when they last changed. If you keep using Kemback after a change takes effect, the new terms apply.

17. Everything else

These terms, with the Privacy Policy, are the whole agreement between you and us about the Service. If any part can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later. You can’t transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets, and we’ll tell you if we do.
